Inquest & PM report consistent…Sanjay Roy raped and murdered the RG Kar Doctor, claims CBI chargesheet
CBI on Monday submitted their first charge sheet pertaining to the horrific RG Kar incident, naming Sanjay Roy as the sole accused who had raped and murdered the 31-year-old medical student on August 9. Sanjay Roy was arrested by Kolkata Police on August 10, within 12 hours since the brutal crime. He was later handed over to CBI as Calcutta High Court transferred the case to the central agency on August 13.
Sanjay “reached the third floor of the Emergency Building (chest medicine department) at 04.03 hrs and entered the seminar room where the victim was sleeping alone. Sanjay Roy committed the crime of rape and murder of the victim and left the third floor at 04.32 hrs”, read the CBI chargesheet. The chargesheet affirms this conclusion relying on the CCTV footages of the hospital which has captured Sanjay going towards the ward on the third floor leading to the seminar room “wearing T-shirt, jeans and holding his helmet on his left hand and Bluetooth neckband earphone around his neck” but while he was leaving the neckband earphone was missing from his body, exactly what the Kolkata Police too had claimed as one of the most crucial links that had helped them zero in on Sanjay before his “own confession” and followed by forensic results and medical tests on him. According to CBI, the CRD and CAF of Sanjay’s mobile phone corroborated “his presence at the hospital at the relevant times”
According to the 45-page voluminous charge sheet, CBI had sent fresh Exhibits, physical evidences seized by them along with fresh blood sample of accused Sanjay, autopsy blood, viscera, and electronic gadgets to both CFSL Kolkata, New Delhi and Chandigarh. Their findings confirmed -
1: Blood on the clothes and shoes of Sanjay belonged to the victim
2: “Human semen present and belongs to accused Sanjay Roy”
3: Saliva detected from the body of the victim belonged to Sanjay, as “confirmed by DNA profiling report”
4: Short hair found at the scene of the crime belonged to Sanjay Roy
The chargesheet details that as per the request of the central agency a Multi Institutional Medical Board (MIMB) was formed comprising of senior members from AIIMs and other New Delhi-based medical colleges under the chairmanship of a Forensic expert from AIIMS New Delhi. The MIMB in its interim report has stated “Perusal of the Magistrate (Judicial) inquest report shows that most of the findings are consistent with the PM report”, vindicating the position of Kolkata Police that has been under the storm of outrage from a section of doctors who had accused the Kolkata Police officials of tampering with evidences. The MIMB report has also stated that the “injuries related to the hymen, which were fresh in origin, are clearly indicating that the victim had suffered forceful penetrative sexual assault” and further corroborated that “swab taken from the area around both *** (body part of the victim) showing the presence of saliva” belonged to Sanjay Roy.
The charge sheet has confirmed that the independent study by forensic experts by AIIMS Kalyani (that comes under the Central government like any other AIIMS) has studied the videography of the inquest and postmortem reports, later opined that “Inquest Proceedings and Postmortem Examination videography are consistent with Postmortem examination report”, yet again confirming that Kolkata Police findings were not concocted or adulterated.
It has been over sixty days since the heinous crime. While Sanjay Roy has been identified as the prime accused, CBI has also shown the former principal of RG Kar MCH Sandip Ghosh and former OC of the local police station Abhijit Mondal, arrested in connection with the same rape and murder FIR. The first charge sheet filed by CBI, on the sixtieth day since the crime, however, has briefly touched about Ghosh and Mondal. “The acts/ommisisons on the part of Abhijit Mondal, the then SHO Tala Police Station and Sandip Ghosh, the then Principal of RG Kar MC&H with regard to the attempt to hush up the matter, destruction of evidence have surfaced and both of them have been arrested and both of them presently, are in Judicial custody. The investigation against them on the aspect of larger conspiracy including in-depth investigation on the aspect of involvement of others, if any, in the commission of crime or its abetment is in progress. After completion of further investigation, supplementary Final Report will be filed”, read the CBI chargesheet.
Cognisance of the chargesheet has been taken by the court and trial in the matter will begin from November 4, the hearing will be in camera and shall happen four days a week.
